At its simplest, property represents a relationship between people concerning things, rather than just a relationship between a person and a thing. Holding an object does not constitute ownership; a thief holds a stolen wallet but does not own it. True ownership involves a bundle of rights, primarily the right to exclude others and the power to transfer the item to someone else. This distinction separates physical possession from legal title. Some theorists argue only tangible items like land or goods count as property because they can be physically possessed. Others broaden the scope to include alienable assets, meaning any right that can pass to another person, such as bank balances or patents. Rights like voting or marrying remain excluded because they cannot be sold or inherited. This broader view encompasses everything that could pass to creditors upon insolvency or be left by will.
John Locke offered one of the most enduring justifications for private property. He argued that individuals own their own bodies and labor. When a person mixes that labor with unowned resources, like farming a plot of land, the resulting produce becomes their property. This labor theory grounds ownership in personal effort. Hegel approached the concept differently, viewing property as an extension of the self. For Hegel, owning things allows individuals to express their will in the external world. Property becomes necessary for personality to develop fully. Without the ability to claim objects, human freedom remains abstract rather than realized. These differing foundations create friction in modern application.
Property stemming from labor raises questions about passive income. Does corporate ownership hold the same moral weight as a family home when the foundation is personality expression? Digital economies complicate the picture further. Users often license software rather than own it, possessing no alienable rights to the code they rely on daily. Such arrangements challenge traditional notions of possessability.
Society currently faces a pressing tension between exclusive rights and collective survival. When private ownership of essential resources like water or medication conflicts with public need, the philosophical justification for exclusion weakens.
